Welcome to Habit, an AI-powered “personal board of advisors” service provided by StartHabit (“StartHabit,” “we,” or “us”). These Terms of Service (“Terms”) govern your access to and use of the Service, including any content, functionality, personas, integrations, and features offered through our web app and connected channels. By creating an account, connecting a channel or tool, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
You represent that you are at least 18 years old (or the age of majority in your jurisdiction, if higher) and legally capable of entering into a binding agreement. If you use the Service on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.
2. Description of the Service
Habit lets you create and talk to AI personas — AI representations of real expert knowledge and thinking styles — and lets those personas use knowledge bases and connected business tools you authorize. Key aspects of the Service include:
Personas. You can create personas with custom prompts, knowledge bases, and tools, and converse with them for research, analysis, drafting, and decision support.
Channels. You can use Habit through the web app and connect messaging channels — Slack, Telegram, WhatsApp, and email — so personas can respond where you work. Each channel is connected with your authorization and is governed by that platform’s own terms.
AI-powered assistance. The Service uses advanced AI (including third-party AI providers) to analyze conversations, conduct research, generate reports and recommendations, and perform tasks on your behalf.
Third-party integrations. Habit can connect to third-party tools (for example ClickUp, LinkedIn, Meta Ads, Google Ads, Gmail and other Google Workspace services, TikTok, HubSpot, GitHub, Linear, Notion, and others). Each integration requires your explicit authorization via OAuth or an API key and is governed by the respective platform’s terms. Where an organization or team shares an integration, authorized members may use it through Habit, and actions may execute using the connected account’s permissions.
Autonomous and proactive operations. Depending on your configuration, personas may run scheduled tasks, respond to inbound events (e.g., emails or webhooks), and proactively generate outputs. Some actions may execute without per-action human review; others may require explicit approval before execution.
3. Account Registration and Security
Authorization. You represent that you are authorized to connect the channels and tools you connect, and to grant the permissions they request.
Account security. You are responsible for maintaining the security of your account and any connected third-party accounts and credentials.
Shared integration responsibility. If you connect an integration that is shared with a team or organization, you represent that you are authorized to do so. Because shared integrations may be used by authorized members through Habit, you are responsible for the granted scopes, account-level permissions, and resulting access to data and actions.
Responsibility for use. You are responsible for all activity that occurs through your account, including actions taken by a persona on your behalf after receiving approval or under your pre-authorization settings. Notify us immediately at support@starthabit.com of any unauthorized activity.
Authorized users. You agree to ensure only authorized people interact with your personas for your purposes, and are responsible for their compliance with these Terms.
4. User Permissions and Data Access
By connecting channels and tools, you grant StartHabit the permissions necessary to access and process data on your behalf:
OAuth consent. Connecting a channel or tool presents that provider’s consent screen detailing the permissions requested. By granting consent, you authorize us to use those permissions to provide the Service. You may revoke access at any time from within Habit or from the provider’s own settings.
Scope of access. With your permission, Habit reads and responds to messages where it is invited or addressed, processes content you send, accesses connected-tool data to perform requested tasks and generate insights, and executes approved actions on connected platforms.
Platform-specific commitments. Our access to Meta and Google data is described in, and limited by, our Privacy Policy (Meta Platform Compliance and Google API Services Limited Use sections). In particular, we do not sell platform data, do not use it for advertising, and do not use Google user data to train generalized AI/ML models.
Use of data. Data obtained from your channels and connected tools is used strictly in accordance with our Privacy Policy. We do not sell your data for monetary consideration.
5. Approval Mechanisms and Autonomous Actions
Low-risk actions. Personas may autonomously perform read-only operations, conduct research, generate outputs, and communicate through your channels, and may execute other actions you have configured as pre-authorized.
Higher-risk actions. Actions that modify external systems or have significant impact may require explicit approval (e.g., via an approval prompt) before execution.
Pre-authorized actions. If you enable auto-approval, recurring workflows, shared-integration permissions, or similar settings, you authorize Habit to execute covered actions without per-action human approval.
Approval authority. You are responsible for ensuring only authorized people can view and approve action requests, including by maintaining appropriate channel and access controls. Approval by a user with access to the request constitutes authorization to proceed.
Execution responsibility. Once an action is approved or allowed by your settings, Habit will attempt to execute it. You are ultimately responsible for the consequences of approved or pre-authorized actions.
Control and revocation. You are responsible for promptly updating or revoking approvals, connections, permissions, and workflow settings when roles or requirements change.
6. Acceptable Use Policy
By using Habit, you agree that you will NOT:
Illegal activities. Use the Service for any unlawful or fraudulent purpose.
Infringement of rights. Infringe or misappropriate the intellectual property, privacy, publicity, or other rights of any person or entity.
Export controls and sanctions. Use the Service in violation of applicable export-control, sanctions, or trade laws, or by or for any restricted person or entity.
Violation of platform policies. Use the Service in ways that violate the terms of Slack, Telegram, WhatsApp, Meta, Google, or any other connected platform.
Unauthorized access. Attempt to gain unauthorized access to any system, account, or data related to the Service or connected platforms.
Harmful or deceptive use. Create content that is false, misleading, defamatory, obscene, or that promotes hate, violence, or illegal activity.
Phishing, malware, impersonation. Create or distribute phishing content, malware, harmful code, or deceptive impersonations.
Interference. Interfere with or degrade the Service, including by abusing automation, scraping outside intended use, or imposing unreasonable load.
Spam and abuse. Send unsolicited messages or spam, or abuse connected systems.
Circumvention. Bypass usage limits, approval mechanisms, or security features.
High-risk use cases. Use the Service for weapons development, unlawful surveillance, or in contexts where failure could reasonably cause death, personal injury, or severe physical, environmental, or property damage.
Violation may result in immediate suspension or termination of access and may expose you to legal liability. We may investigate suspected violations, suspend or terminate access, and cooperate with law enforcement or regulators where appropriate.
7. Data Handling and Privacy
By using the Service, you acknowledge and agree that StartHabit will collect, use, and process data as described in our Privacy Policy, incorporated by reference. Key points:
Channel and content data. We access and process the messages and content you send to personas across the web, Slack, Telegram, WhatsApp, and email to provide the Service.
Connected-tool data. Data from connected tools is accessed to perform requested tasks and may be stored to provide Service functionality.
AI processing. Content is processed by automated AI systems, including third-party AI providers. We do not use your content to train our own foundation models, and we do not authorize providers to train their general-purpose models on it. We do not use your content for advertising.
Data removal. You can request deletion of your data at support@starthabit.com. Disconnecting a channel/tool or revoking access stops new data collection from that source but does not by itself delete previously stored data. If your account is closed or we receive a validated deletion request, we delete previously stored data in accordance with our Privacy Policy.
8. Intellectual Property Rights
All software, algorithms, and materials comprising the Service are the property of StartHabit or our licensors and are protected by intellectual-property laws.
License to you. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your internal business or personal purposes.
Restrictions. You will not copy, modify, distribute, or create derivative works based on the Service’s code or content, and will not reverse engineer or decompile it.
Your content. You retain ownership of your data, prompts, knowledge bases, and messages. You grant StartHabit a limited license to use that content as necessary to provide the Service.
AI-generated content. Outputs generated by your personas are provided as work product for your use; you may use them for your purposes, subject to these Terms and applicable third-party terms.
Feedback. If you provide feedback or suggestions, we may use them freely without obligation to compensate you.
9. AI Content and Disclaimers
AI-generated content may be imperfect. AI is not infallible. Outputs may be incorrect, misleading, incomplete, or inappropriate. You are responsible for reviewing and verifying AI-generated content before acting on or relying on it.
No professional advice. Outputs are not professional legal, financial, tax, medical, or other specialized advice. Use your judgment and consult qualified professionals when appropriate.
User responsibility. You are ultimately responsible for decisions and actions taken based on Habit’s output.
No guaranteed human review. Autonomous tasks and pre-authorized workflows may execute without real-time human review.
Platform compliance. You are responsible for ensuring actions executed through Habit comply with connected platforms’ policies and applicable laws.
10. Pricing and Future Paid Features
The Service may offer free and paid plans. We reserve the right to modify pricing or introduce new plans or features in the future. If we make changes that affect your current plan, we will provide at least 30 days’ advance notice by email and/or in-app message.
If you subscribe to a paid plan: fees are charged via our payment processor in the currency specified; subscriptions are billed in advance for the cycle you select and renew automatically unless cancelled before the end of the period; cancellation takes effect at the end of the current period; and fees are generally non-refundable except at our discretion or where required by law.
11. Termination of Service
By you. You may stop using the Service at any time by disconnecting your channels and tools and closing your account. Disconnecting stops future data collection from those sources. If your account is closed or we receive a validated deletion request, we delete previously stored data in accordance with our Privacy Policy. You may also contact support@starthabit.com to request deletion.
By us. StartHabit may suspend or terminate your access at any time, with or without notice, if we believe that (a) you have violated these Terms, (b) you pose a security, legal, or business risk, or (c) we decide to discontinue the Service. We may also limit or disable specific integrations, features, or accounts where reasonably necessary for security, legal compliance, or risk mitigation.
Effects of termination. Upon termination, your right to use the Service ceases. Provisions that by their nature should survive (such as indemnification, disclaimers, limitation of liability, and governing law) will survive.
12. Disclaimers of Warranties
The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, StartHabit disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We make no warranty regarding the accuracy, quality, or reliability of any AI-generated content, and we are not responsible for the availability or functioning of third-party services the Service relies on. Some jurisdictions do not allow certain warranty exclusions; in those jurisdictions the exclusions apply only to the maximum extent permitted by law.
13. Limitation of Liability
To the maximum extent permitted by law, StartHabit and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, business interruption, or reputational harm, arising out of or related to your use of the Service.
In no event will StartHabit’s total cumulative liability for all claims arising from or related to the Service exceed the amount you paid us for the Service in the twelve (12) months preceding the claim (or, if you have not paid us, €0).
We are specifically not liable for: actions taken by a persona on connected platforms; decisions made based on AI recommendations; or any consequences of approved or pre-authorized actions. Some jurisdictions do not allow these limitations; in those jurisdictions liability is limited to the maximum extent permitted by law.
14. Indemnification
You agree to indemnify, defend, and hold harmless StartHabit and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or relating to: your use of the Service; actions executed by a persona on your behalf after approval or under your pre-authorization settings; your configuration of shared integrations, permissions, automations, or approval policies; your violation of these Terms or any applicable law; your violation of any third-party platform’s terms; or content created or actions taken using the Service.
15. Modifications to the Service and Terms
We may modify, update, or discontinue the Service (or any part of it) at any time, with or without notice. We may revise these Terms from time to time; if we make material changes, we will notify you through reasonable means (such as email or in-app notice). By continuing to use the Service after updated Terms take effect, you accept the changes.
16. Governing Law and Jurisdiction
These Terms and any dispute arising out of or relating to the Service are governed by the laws of the European Union (and the applicable law of your EU/EEA country of residence), without regard to conflict-of-law principles. Users accessing the Service from outside the EU/EEA are responsible for compliance with their local laws. Nothing in these Terms limits the non-waivable rights you have as a consumer under the law of your country of residence.
17. Dispute Resolution
We prefer to resolve disputes informally. Before initiating any formal proceedings, please contact us at support@starthabit.com and allow at least 30 days for good-faith informal resolution.
If a dispute cannot be resolved informally, it will be handled under the governing law in §16, and your non-waivable statutory consumer rights — including any right to bring proceedings in your country of residence — remain fully unaffected. Either party may still seek injunctive relief for intellectual-property misuse, unauthorized access, or confidentiality violations.
18. Miscellaneous
Entire agreement. These Terms, together with the Privacy Policy, are the entire agreement between you and StartHabit regarding the Service.
Waiver. Our failure to enforce any provision is not a waiver.
Severability. If any provision is held invalid or unenforceable, the remaining provisions remain in effect.
Assignment. You may not assign these Terms without our prior written consent. We may freely assign these Terms.
No agency. No joint venture, partnership, employment, or agency relationship exists between you and StartHabit.
